1. Policy Positioning:

   • The Seekr Privacy Policy helps you easily understand how we collect, use, and share your personal information and assists you in exercising your privacy rights. This Privacy Policy applies to personal information collected and processed by us in our business, including when you contact us or interact, visit, and use our websites (www.seekr.com).
   • A search engine that knows a bit about you can deliver a great experience while protecting your privacy. At Seekr, we take the responsibility to protect your data seriously, and we are committed to making our Services better for you. Policies should be transparent and easily understood so you are not left wondering how a company treats your information. Therefore, we wrote our Privacy Policy to be transparent; in fact, we highlight the main takeaway for you so you can quickly understand our position.

2. Personal Information Collection:

   We and our third-party vendors collect and store any information that you provide to us, including your account information, information about your device, and the ways you use and interact with our Services.

       • Account info: email address, name, phone number, city, or zip code, when you sign up to be a beta tester or get our newsletter, request technical support, or communicate with us via our feedback feature.
       • Your contacts: we may collect information from you about the contacts you choose to share and promote our service to, such as sharing a search result or sharing content from our search engine.
       • Your settings: Information you choose to share and/or save with us will be stored. For example, when you enter your zip code to get local news results and/or offers.
       • Surveys: We may collect and contact you when you opt to participate in a survey. In this case, you may be asked to provide personal information.
       • Social Media: You may follow us on social media or opt to join a forum owned by Seekr. In this case, any content you provide will be considered “public” and is governed by the Privacy Policy of the company providing them (i.e., Instagram).
     • Automatic Collection:
       • Seekr and its vendors, including third parties, automatically collect information when you use our Services. This information may include:

         • Location information
         • User settings
         • Referrer URL

         • Operating system
         • Device type
       • Seekr and its vendors, including third parties, may also collect information about how you use our Services: queries, content you interact with, frequency of visits, and/or duration of your activities.

We use cookies and similar technologies for storing and honoring your preferences, providing interest-based advertising, combating fraud, and analyzing how our products perform.
       • We and/or third parties, including advertising companies, social networking sites, and service providers on our behalf, use cookies, web beacons, and other similar technology, to collect information for the purposes described in this Policy, including advertising, analytics, online behavioral marketing, and re-targeted advertising, monitoring performance and improvement of our online services (traffic, errors, page load time, popular pages, etc.).

         • This Policy does not apply to, and we are not responsible for, third-party cookies, web beacons, or other tracking technologies, which are covered by such third parties' privacy policies. 3. External Links to Third-Party Services:

   The Services may contain links to third-party websites and applications. Links to such applications and any other websites operate with privacy policies beyond our control. Once you have left our websites or applications, any personal information you provide to third parties is governed by the Privacy Policy of the third-party websites or social media account's operators. We are not responsible for your interactions on these websites and applications, and we encourage you to review their privacy policies.

4. How Do We Use the Personal Information That We Collect?

   We use your information primarily to provide, operate, and improve the Services you use and to maintain security of information. We also use your information to communicate with you, protect you and others, and carry out our marketing, legal, and other business obligations.

   • For Operations: We use technologies that allow us to prevent fraudulent activity, identify irregular behaviors (i.e., bots), and/or improve security.
   • For Functionality: We may use technologies that allow us to offer you more choice and control. This may include account creation, tracking of preferences, interests, or saved information.
   • For Administration and Performance of Our Services: We may use the data we collect to improve the performance of our Services and business. We use your information to provide you with the Services and to continuously improve them. This means we use your information, for example, as follows:

   We will automatically anonymize search and location history after 90 days from when it is collected. We will automatically delete search and location data after 18 months.

5. Sharing of Information:

   We share your information with third-party vendors and service providers, who help us provide our Services when necessary. This allows us to comply with legal obligations within the Seekr group and in the event of a merger.

   • Service Providers: We may share your personal information with service providers who support our business and operations:
     • IT-related services
     • Analytics providers
     • Customer service providers
   • Third-Party Vendors: We may share your personal information with third-party vendors who support the provisioning of our Services, including entities that assist us in communicating with you and market to you, such as social media companies and companies providing data analytics, targeted advertising, etc.
   • As Legally Necessary: We may access, preserve, and disclose any information we store associated with you to external parties, including courts, and government entities, if we, in good faith, believe doing so is required under law, regulation, or court order or appropriate to comply with law enforcement or national security requests and legal process.
   • Within the Seekr Technology Group
   • In the Event of Merger, Sale, or Other Asset Transfers: We may share some information, such as a list of Seekr customers, in connection with a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider.
   • Consent: We may share personal information with your consent and at your direction.

6. Your Data, Your Choice and Control:

   We automatically anonymize your search and location data after 90 days and we automatically delete your search and location data after 18 months. You can choose to use the private mode in your browser to limit the information we store and collect about you. You may also unsubscribe from marketing communications at any point.

   • Marketing communications: you can use the unsubscribe link found at the bottom of any Seekr email to opt out of receiving such emails.
   • Private browsing: You can use controls in your internet browser to limit how the websites you visit can use cookies and withdraw your consent by clearing or blocking cookies.Even if you opt out, we may still collect and use information that is de-identified, aggregated, anonymous, or otherwise not in a personally identifiable form for the purposes described herein.

7. Children's Information:

   We do not knowingly collect information from children under 13.

   • Our Services are not intended for or directed toward children under the age of 13, and we do not knowingly collect personal information from children under the age of 13. If we become aware that we have obtained personal information from a child under age 13, we will delete such information in accordance with applicable law.

8. Notice to California Residents:

   In addition to the other information provided throughout this Privacy Policy, we provide the following information to collectively serve as a notice to residents of California (“California consumers”) in accordance with the California Consumer Privacy Act (“CCPA“).

   • Internet Usage Information, such as browsing history, search history, and information regarding a consumer's interaction with our website, application, or advertisement.
   • Geolocation Data, through the use of our Apps and Services.
   • Sensory Data, such as audio recordings of customer service calls.
   • Inferences derived from personal information, such as information about your interests or purchase preferences.

   We do not knowingly sell the personal data of consumers under 16 years of age.

   California Consumer Privacy Rights:

   • Right to Delete: You have the right to request the deletion of your personal information collected or maintained by us, subject to certain exceptions permitted by law.
   • Right to Opt-Out of Sale of Personal Information: You have the right to opt out of the sale of your personal information. Seekr does not sell your personal information for money. However, the CCPA's definition of a “sale” is both unique and broadly worded and captures disclosures beyond monetary exchanges. For example, sharing your data with third-party networks to serve you with ads tailored to your preferences across various platforms may be considered a “sale” under CCPA.      Please Note:

     • Opt-outs are device and browser-based. You must opt out on each device and browser where you want your choice to apply.
     • Opt-outs may be stored via cookies. If you clear cookies, your opt-out may no longer be valid, and you must opt out again where you want your choices to apply.
     • We may still share your personal information with our service providers that help us perform necessary functions for our business, such as vendors that host our Site, analytics processors, etc. These entities are contractually obligated to keep this information confidential and not use it for any purpose other than the Services they provide to our business.
     • You may still receive ads from us that are not tailored to your interests.
   • Right to Non-Discrimination: You have the right not to receive discriminatory treatment for exercising your CCPA privacy rights. We do not use the fact that you have exercised or requested to exercise any CCPA rights for any purpose other than facilitating a response to your request.

   Making a CCPA Request

   Once we receive your request, we are required to verify that you are the person that is the subject of the request (the “Verification Process”). The Verification Process consists of matching identifying information provided by you with the information we have about you in our records. Upon making a request, you will be asked to provide your name and email address. A confirmation email will be sent to the email address you provide to verify that you are the subject of the request. If we cannot verify your identity, we will not be able to respond to your request.

   Authorized Agent

   You may designate an authorized agent to exercise any of the above California privacy rights on your behalf, subject to the agent request requirements of the CCPA. Authorized Agents may make requests under the CCPA on behalf of California Consumers by contacting us at support@seekr.com

   California's Shine the Light Law. If you are a California resident, you are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. We do not disclose your information to third parties for their direct marketing purposes. If you have any further questions, please email us at: support@seekr.com . Do Not Track Signals — California law requires us to let you know how we respond to web browser Do Not Track (“DNT”) signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

9. Security of Your Information:

   We store your data on servers in the United States and we work hard to protect it.

   • We collect and store all data in the United States. We are taking steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unintentional disclosure. By using the Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services. If we learn of a security system's breach, we may attempt to notify you electronically by posting a notice on the Services by mail or by emailing you.

10. Changes to Privacy Policy:

    We will let you know when we make updates and/or changes to our Privacy Policy.

    • We may revise this Privacy Policy from time to time at our sole discretion. If there are any material changes to this Privacy Policy, we will notify you in our Services and as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use the Services after the new Privacy Policy takes effect.
